Acceptable Use Policy

Opiniac is operated by Yosuble AI LLC, a New Mexico limited liability company (1209 Mountain Road Pl NE, Ste R, Albuquerque, NM 87110, USA). This Acceptable Use Policy (“AUP”) supplements our Terms of Service and applies to anyone who uses Opiniac.

Opiniac gives you generative AI tools to create YouTube thumbnails, e-commerce product shots, and to enhance images (upscaling, background removal). The same tools could be abused to harm real people. This policy explains what we do not allow. Violating it can result in warning, content removal, account suspension, termination without refund, and — where applicable — reports to law enforcement.

01 — Identity & consent

When you upload a photo that shows a human face, you represent and warrant that:

  • the face depicted is your own, or
  • you have obtained documented, informed, and revocable consent from every identifiable person appearing in the image for their likeness to be uploaded, processed by AI, modified, and published, and
  • the person is an adult (18+) at the time consent was given.

We may, at any time, ask you to provide proof of consent. Failure to provide it on request is itself a violation of this AUP.

02 — Prohibited uses

You must not use Opiniac — or any output generated with Opiniac — to create, upload, generate, store, share or publish any of the following:

  • Deepfakes and face swaps of real people without their explicit, documented consent, including face swaps onto another body or into another scene.
  • Non-consensual intimate or sexual imagery of any real person, including undressing, “nudifying”, or sexualising subjects.
  • Any sexual content involving minors, real or fictional, or any content that sexualises anyone under 18.
  • Impersonation of public figures — politicians, celebrities, journalists, executives — in a way that could mislead viewers about real events, statements, endorsements, or actions.
  • Election, political or civic disinformation: fabricated images of candidates, officials, ballots, polling stations or protests intended to deceive.
  • Fraud and scams: fake receipts, invoices, IDs, passports, KYC selfies, bank statements, medical records, or anything designed to deceive a verification system.
  • Harassment, stalking, doxxing, targeted intimidation, hate speech, or content that dehumanises a person or protected group.
  • Violent, graphic, or self-harm contentglorifying, promoting, or instructing violence, terrorism, self-injury, or suicide.
  • Illegal goods and regulated activities: content promoting weapons, drugs, human trafficking, or the sexual exploitation of any person.
  • IP and trademark infringement: logos, brand assets, stills from protected films, games or shows used to imply an endorsement or origin you do not have rights to.
  • Circumvention: any attempt to bypass safety filters, rate limits, watermarking, or the consent controls of this policy — including prompt-injection and jailbreaking.

03 — Content moderation

Uploads and generated outputs may be scanned by automated safety systems (including model-provider safety classifiers and, where legally applicable, CSAM detection) to enforce this policy. We may block generation, delete content, and — where required by law — preserve and report it. We do not use your uploads or outputs to train models.

04 — IP indemnity

You agree to defend, indemnify and hold harmless Yosuble AI LLC and its officers, employees, and partners from and against any claim, demand, loss, liability, damage, fine or expense (including reasonable attorneys’ fees) brought by a third party and arising out of: (a) content you uploaded or prompted; (b) your use of outputs generated with Opiniac; (c) your breach of this Acceptable Use Policy, the Terms of Service, or applicable law; or (d) your infringement of any intellectual property, publicity, privacy or other right of a third party.

05 — Reporting abuse (DSA notice-and-action)

If you believe any content generated or distributed through Opiniac violates this Acceptable Use Policy or is otherwise illegal, you can submit a notice to abuse@opiniac.app. This mechanism implements the notice-and-action procedure required by Article 16 of Regulation (EU) 2022/2065 (the Digital Services Act).

What a valid notice must contain:

  • a sufficiently substantiated explanation of the reasons why you consider the content illegal or in breach of this AUP;
  • a clear indication of the exact electronic location of the content (URL, share link, generation ID) and, where relevant, additional information to help us identify it;
  • your name and email address (except for reports of offences under Articles 3–7 of EU Directive 2011/93/EU — child sexual abuse material — which may be submitted anonymously); and
  • a good-faith statement that the information in the notice is accurate and complete.

How we handle notices:

  • Acknowledgment: we send an automated confirmation of receipt without undue delay.
  • Decision: we review the notice diligently, in a non-arbitrary and objective manner, and take the appropriate action — which may include removing the content, disabling access, suspending the account, or, where the notice is unfounded, leaving the content in place.
  • Statement of reasons: where we act on the content, we provide both the reporter and, where possible, the affected user with a clear statement of reasons (scope, facts, legal or contractual basis, available remedies), consistent with Article 17 DSA.
  • Priority categories: reports concerning non-consensual intimate imagery, CSAM, and immediate threats to life are handled as top priority. Other credible reports are actioned as fast as reasonably possible; we target an initial decision within 72 hours.

Appeals & out-of-court redress. If you are the reporter or the affected user and you disagree with our decision, you can appeal by replying to our decision email within 6 months; appeals are reviewed by a person who was not involved in the original decision. Users located in the EU also retain the right to select a certified out-of-court dispute-settlement body (DSA Art. 21) or bring the matter before their competent court.

06 — Enforcement

Violations of this AUP are a material breach of our Terms of Service. We may, at our sole discretion and without prior notice, remove content, suspend or terminate accounts, revoke credits, retain paid fees, and cooperate with legal authorities. We reserve the right to update this policy as risks evolve; material changes will be posted on this page with a new “last updated” date.
